In a first, the Mumbai FDA has granted permission to licensed homeopaths to prescribe allopathic drugs. The reason cited was a push in healthcare in rural areas. While some quarters have hailed the move, there has been severe criticism of the move from the medical fraternity.
Chemists and druggists in Maharashtra have been instructed to accept prescriptions for allopathic drugs issued by homeopaths who have a certificate course in modern pharmacology.
The directive was finalized and issued on Thursday.
Background and Legal Framework:
In 2014, amendments to the Homeopathic Practitioners' Act and the Maharashtra Medical Council Act permitted registered homeopaths to practice allopathy after they had completed a certified pharmacology course.
However, chemists have been refusing to abide by these prescriptions due to vagueness in the Drug and Cosmetic Act.
Effect of the Judgment:
Thousands of homeopaths who have completed pharmacology courses since 2014 will now have their prescriptions honored.
The change will improve access to healthcare in rural and semi-urban areas, where qualified allopathic doctors are scarce.
Support and Criticism
Support:
Homeopathic doctors welcomed the move, claiming that it could bridge the gap in healthcare in underdeveloped areas.Criticism:
The Indian Medical Association (IMA) expressed strong opposition, labeling the homeopaths as “half-baked allopathic doctors.”
Santosh Kadam, IMA president, criticized the decision, arguing that it undermines the rigorous training required for MBBS doctors.
Legal Challenges:
The IMA had previously challenged the state’s allowance for homeopaths to practice allopathy in court, and the matter remains sub-judice.
The association plans to challenge this latest FDA order as well.
Statements from Stakeholders:
Dr Bahubali Shah, Administrator, Maharashtra Homeopathic Council:
He noted that the move is in tandem with legislative amendments introduced in 2014 and will be beneficial to both homeopaths and patients in rural areas.
Santosh Kadam, President, Indian Medical Association:
He raised concerns over the safety of patients and mushrooming of untrained practitioners.
Homeopathic Practitioner (anonymous):
Welcomed the decision that will help fill the void of medical practitioners in rural areas. While the FDA's decision is aimed at improving rural healthcare, it has reignited the longstanding debate over the qualifications needed to prescribe allopathic medicines. As legal challenges loom, the implications for Maharashtra’s healthcare landscape remain to be seen.
